Anti-Piracy measures made more stringent; jail term up to 3 years

The menace of piracy has been a major headache affecting the financial health of the film industry in India. A recent news report noted that losses due to piracy were estimated to be to the tune of Rs 3,700 crore in 2024. From arrests to digital tracking, multiple steps have been undertaken concurrently to nab the culprits responsible for bringing out piracy prints of fresh theatrical releases. In this regard, a recent notification by the Government of India to further strengthen specific measures to curb Digital Piracy in the film industry is a welcome move. The Ministry of Information and Broadcasting, in an earnest endeavour to control piracy, outlined some stringent measures as part of its larger efforts under the Cinematograph Act (1952) . Here are the clauses : A minimum 3-month imprisonment and a fine of Rs 3 lakh, extendable to 3 years imprisonment . Additionally, a fine up to 5 of the audited gross production cost can be imposed. Section 6AA and 6AB of the Cinematograph Act prohibit unauthorized recording and transmission of films. A fresh rule empowers the Government to issue necessary directions to intermediaries hosting pirated content. The I amp;B Ministry and the Central Board of Film Certification (CBFC) are empowered to receive complaints from copyright holders or authorized persons and issue directions to intermediaries. Besides, an inter-ministerial committee has been constituted to strengthen anti-piracy strategies and develop coordinated action plans. The emphasis on coordinated action shows the extent of serious efforts going on at the highest level. The Government remains engaged with stakeholders, including law enforcement agencies, to curb digital piracy and protect India's entertainment ecosystem, an official notification mentioned, iterating the official resolve. The government's support in curbing back-breaking piracy is commendable. Various stakeholders, especially producers, distributors and exhibitors, highly appreciate these efforts.
